The Supreme Court handed immigration hawks a win after ruling against Biden’s efforts to end the Migrant Protection Protocols. The “Remain in Mexico” policy was started by Trump.
Summary
Trump’s “Remain in Mexico” immigration asylum policy must be reinstated after a U.S. Supreme Court ruling.
- The policy, formally called the Migrant Protection Protocols (MPP), required those seeking asylum in the U.S. to wait in Mexico until their asylum hearings.
- The Supreme Court referenced its ruling last year’s order that prevented Trump from ending the Obama-era DACA policy, in which they ruled the Trump administration did not follow federal procedures in trying to wind down DACA.
- After the ruling, the Department of Homeland Security said they would continue to challenge the program.
- The Supreme Court’s ruling broke along “partisan” lines, with 6 justices considered conservative siding in favor of keeping the MPP in place and the three liberal justices dissenting.
- The New York Times highlighted reaction from pro-immigration advocates who said the Supreme Court was “abandoning its commitment to restore a fair asylum system.”
- Vox, which has avoided using its “explainer-style” reporting on anything Afghanistan-related, is suddenly obsessed with norms and principles, saying “One of the most foundational principles of court decisions involving foreign policy is that judges should be extraordinarily reluctant to mess around with foreign affairs.”
- Slate, in comparing the ruling to last year’s DACA ruling, said it was “the same legal reasoning” that stopped “noxious Trump policies” on immigration.
- The New York Post stated that the “Remain in Mexico” policy was largely abandoned by the Trump administration at the start of the coronavirus pandemic when nearly everyone was prevented from crossing the border.
- RedState reminded its readers the SCOTUS decision “isn’t a full decision on the merits”, only that the appeals court ruling will not be suspended while appeals continue.
- Breitbart noted the judge that originally ordered the Biden administration to reinstate the Remain in Mexico policy is a Trump appointee.
